Mose Adam Smith Found Guilty of Voluntary Manslaughter in Federal Court
GRANT COUNTY, Wis. (CIVIC MEDIA) – The United States Attorney’s Office for the Eastern District of Oklahoma has announced that Mose Adam Smith, 43, of Stilwell, Oklahoma, was found guilty of Voluntary Manslaughter in Indian Country. The jury delivered its verdict on April 10, 2023, following a trial that began April 7. Smith faces a potential sentence of up to 15 years in prison and a fine of up to $250,000.
The case stems from an incident on July 17, 2023, when Smith unlawfully killed a victim during an altercation at the victim’s residence in Sallisaw, Oklahoma. Evidence presented by the prosecution indicated that Smith inflicted blunt-force trauma, leading to the victim’s death. After the altercation, Smith attempted to conceal the crime and fled the state.
The investigation took a turn on July 24, 2023, when the Grant County Sheriff’s Office received a request related to a disturbance at a campground involving a knife. The two suspects, Smith and his co-defendant Kimberly Dawn Ball-Gilbert, 42, abandoned their vehicle near Platteville, Wisconsin, and were found walking nearby. A license plate check linked their vehicle to a missing person case from Sallisaw, Oklahoma.
Smith and Ball-Gilbert were interviewed, and evidence was collected, leading to the confirmation of the victim’s death. On March 19, 2025, Ball-Gilbert pleaded guilty to one count of Voluntary Manslaughter, admitting to aiding Smith in the crime.
Sentencing for both Smith and Ball-Gilbert will occur following the completion of pre-sentence reports, with both remaining in U.S. Marshals’ custody until then.
